Adding roommates to a month-to-month lease, how much can rent go up?

hey y’all… so I’ve got a question about adding roommates to a rental in Santa Ana. let’s say someone’s got a month-to-month lease and wants to officially add 2 more people. once the addendum for the new folks is signed, how much can the rent be bumped up per person? also, if the current tenant already had a rent increase within the past year, how much notice does the landlord need to give for the change in terms?

good question… I’ve wondered the same thing. if rent already went up in the past year, I don’t think they can just bump it up again without restrictions.

yeah I read somewhere that there’s a limit to how much they can raise it in a 12-month period, especially in cities with rent control.

yep! they passed some rent stabilization stuff not long ago. I think it limits annual increases to like 3% or 80% of CPI, whichever’s lower.

from what I know, adding people might justify a rent hike, but if a raise already happened this year, you’re kinda capped unless they move out and re-sign.

right, and I think the notice to change terms is like 30 days? unless the increase is over 10%, then it’s 90 days IIRC.

ah gotcha, makes sense. didn’t know about the 10% rule… thanks for clearing that up.

adding 2 ppl sounds like a big change, but legally the landlord can’t just raise rent a ton. they still have to follow the notice rules and percentage limits.

exactly. even with an addendum signed, they can’t just throw in a crazy increase outta nowhere.

so just to be clear… if the tenant already had a rent hike in the past 12 months, they can’t get another one for adding roommates?

not unless the combined increases stay within the yearly allowed limit. that’s the key thing.

btw if the lease is month-to-month, the landlord still has to follow all the notice rules even for just changing terms like adding roommates.

makes sense… I figured being month-to-month might make it easier, but seems like there’s still rules to follow.
