I was diagnosed with moderate PTSD back in June 1991 by a VA doctor at the James Haley VAMC in Tampa, but they denied me benefits and treatment. Fast forward 19 years, and I finally started receiving 90% in November 2011. I was told this was ‘gross negligence.’ Now I’m wondering if there’s anything I can do about the possible arrears. Anyone been through something similar?
I think you might have a case. You can appeal it, especially if it was negligence on their part. It’s not uncommon for people to get denied initially and then later receive benefits.

Yeah, I’ve read about similar situations where people got back pay after winning their cases. It might take some time though.

For sure, but it’s worth looking into. You could be entitled to back pay for all those years.
I’d recommend getting your records together. If you’ve got paperwork from the original denial, that could help. Did you try to appeal back in 2015?

Yeah, I did appeal it in 2015, but they denied it again. I’m really just trying to figure out if I can get something for the missed benefits from before.
It sounds like you may be able to file a negligence claim too. That’s what happened with a friend of mine. It could be worth pursuing that route.

That’s good to know. I’ve heard that the negligence claim could get a big payout if successful. How do I even start that process?
You’re not alone, I’ve been through a similar situation. If the negligence was truly on their part, you might be entitled to a settlement, and it could be pretty significant.
