So I’ve been looking into what rights adoptive parents actually have… There seems to be a lot of legal stuff involved, and some of it’s kind of confusing. Like, can adoptive parents actually give up their rights? Or are they totally responsible no matter what? Anyone have experience with this?
Good question! I think it’s tricky. I read somewhere that the court usually won’t let adoptive parents give up rights unless there’s someone else ready to step in for the child.

That makes sense… I guess the court’s all about what’s best for the child, right?

Exactly! The court has to be convinced it’s in the kid’s best interest, not just because the parents want out.
I think adoptive parents might be able to cancel an open adoption agreement if they can prove they were pressured to sign it. Anyone know more about this?

Yeah, if they can show they were forced, the court might step in and cancel it.

Yep, they’d need to prove it legally, but if they do, it could be cancelled by the court.

Not in California! Adopted or not, the will can leave out anyone. Only spouses are guaranteed anything by default.

Yep, exactly. The will is up to the parent unless there’s a spouse in the picture.
In Alaska, they’re really strict about giving up parental rights, right? I read that even if one parent wants out, the court doesn’t just allow it without just cause.

Oh yeah, the court needs some serious justification for it. They’d rather have both parents on board unless there’s someone else stepping in.

Exactly! And if no one’s ready to take over, it’s a no-go.

For sure. They really don’t want any parent just walking away unless it’s best for the child.

Totally agree… it’s like they want to make sure the kid has stability.
