Anyone know about medical malpractice for an old case?

I’m trying to get some help for a situation from 2018 in Alabama. It involves some health stuff after childbirth, and I’m wondering if anyone’s been in a similar boat with a medical case this old. Do I need to go to a lawyer in Alabama or can I handle it from Tennessee?

I’d definitely talk to an Alabama lawyer. My cousin had a similar issue and had to work with a lawyer in the same state where it all happened.

Makes sense. They know the local laws better, right?

@Remy
Yep, especially with malpractice cases, states can vary a lot.

I’ve heard the statute of limitations might be tight. Did they give you any ideas about exceptions for older cases?

They mentioned something about the ‘discovery rule’… IDK exactly how it works, but it seems it might help if I didn’t know about the problem right away.

@Fintan
Oh yeah, I think that means if you couldn’t have known the problem existed earlier, you might have extra time.

@Fintan
Right, so if it wasn’t obvious right after delivery, it might give you a bit more time to file.

Out of curiosity, what was the main issue that led to the complications?

It’s been infections and other issues since then. I think it’s from the swelling that happened after delivery and wasn’t fully treated.

@Fintan
Ouch, that sounds rough. Sometimes it’s hard to get doctors to really follow up on stuff.

Definitely reach out to an Alabama attorney who handles medical stuff. They’ll know the best way to approach a case like this.

For sure. It’s better to talk to someone who knows the area. They’ll probably have more experience with similar cases.

If you’ve got records from your visits and treatments, definitely hold onto those. They’ll be important if you decide to go ahead.

Yeah, I do have all my records from different visits. Thanks for the heads-up!

@Fintan
Good call. The more documentation, the stronger your case could be.
