Just had a process server over and my wife took the papers today. She saw there’s an option for her not to respond and just default to what I’ve filed. Anyone had any issues doing it this way?
Hey! It’s usually not recommended to just let a default happen, even if it seems easier. Lawyers would probably tell her to file a response.

Good to know, thanks! She’s kinda on the same page with me, though, so we just want it finalized fast.

If you’re both in agreement, have her sign the terms and file a waiver. That can make things simpler.
Are you taking care of any shared stuff, like debt or property? That could be a reason to make sure things are super clear in writing.

Yep, I’m covering all the debt, she’s keeping her 401k and the house. We don’t have kids or anything complicated.

Sounds like you’ve got it sorted. As long as everything’s clear, it should be smooth!
So is there a specific form she has to file, or can she skip that FL-120 response if she signs off?

If she signs a waiver, she might be able to skip it. Double-check with the court clerk to be sure, though.

FL-120 is usually needed if they want a response, but with a waiver, it could be simpler.
What about the FL-142 form? Is that the one that needs your signature too?

Yeah, there’s a spot for my signature on her FL-142. Not sure if it’s just to confirm her info is correct.

Probably just a formality, but you could confirm with a family law facilitator. They usually know the details and don’t charge.
Family law facilitators can help with the forms, and some work remotely. Might be worth looking into!

Are they at the court too? Or just online?

They’re usually at the court, but you can also find them online on your state’s court website.
