So, I own some land, and my brother put a house on it like 30 years ago. Now, his daughter’s friends have been moving in, turning the place into a bit of a mess. There’s no lease agreement or anything. Do I have any right to say who can and can’t stay there? Also, how would I go about getting a court order to remove the house if it comes to that?
Honestly, if they’re not paying rent or have any agreement with you, I’d say they’re trespassing. Have you tried getting law enforcement involved?

Yeah, I actually did get the current group evicted, but my niece wasn’t happy and filed a restraining order against me. It’s complicated.

Exactly, no lease at all. Was thinking about the court option, but wasn’t sure how that works. Just a basic civil lawsuit?

Yup! You’d file a lawsuit for trespassing and ejection. A local attorney could help a lot here. Some places even have free legal aid if that’s an issue.

If it’s that bad, with people moving in and causing trouble, law enforcement might help if you explain it’s trespassing. Also, if they’re using the place for, um, illegal stuff, that could push authorities to act quicker.

Yeah, that’s part of it. There was some sketchy activity before. I’ll bring it up with law enforcement again.

Basically, you’d need to file a civil suit. If the court rules in your favor, they’d issue an order for the house to be moved. If the owner doesn’t do it, you might be able to get it done yourself legally.

Yeah, I’d imagine it could take a while. But I think I’ll try it if things don’t improve.

I got some of them out myself, but they just keep coming back or new people show up. It’s hard to control it without legal action.

I’d go with the court route then. Once you have an order, it’s legally enforceable.
