Can I get a 243(e) crime removed from my record... anyone been through this?

Hey everyone, I’m looking for some advice. I recently discovered new evidence in my case, where I pled no contest to a 243(e) (domestic battery) crime in 2017. Turns out, the person who accused me admitted to lying to the police in an email I found! I really want to pursue a career in law enforcement, but I found out that my plea could affect that due to the Lautenberg Amendment. My question is: is there a way to get this removed from my record? Any attorneys here who can help? :worried:

Yeah, I’ve heard that there’s a chance to withdraw your plea if you weren’t fully informed. Maybe that could help here?

Exactly, you could try filing a motion to withdraw the plea. That’s one option. But definitely talk to someone who specializes in post-conviction stuff.

You might want to look into a petition for factual innocence too. If the new evidence shows you didn’t do it, they might clear your name. Just make sure to get a good lawyer on your side. :briefcase:

I didn’t even think about that! I’ll ask my lawyer about it. Thanks for the suggestion .

Just FYI, even if you get it expunged, the Lautenberg Amendment might still affect you in law enforcement roles. But it’s worth trying if you’ve completed all your probation stuff.

Yeah, I’ve done everything they asked for. I’m just hoping this new evidence will help. :crossed_fingers:

I think the key is finding a lawyer who knows about post-conviction relief. It’s definitely complicated, but not impossible. Good luck .

Thanks, I’ve been looking around for someone to help, but it’s been tough to find the right person.

If you’re still struggling to find someone, you could try contacting a chief investigator at the DA’s office. They might be able to point you in the right direction. :mag:

I’m actually waiting for a call back from a chief investigator! Hopefully, they can help me get the ball rolling. Thanks for the tip .
