Hey everyone, I was married to a lieutenant colonel in the Marines for about 15 years. We divorced recently, but he passed away about a year ago, just after starting to receive Agent Orange benefits. He was a Vietnam vet, and I’m wondering if I’m entitled to any of his military pension. He was a career Marine, and we were married for over 10 years. Anyone have any insight on this?
Sorry for your loss. If you were divorced before he passed, you probably won’t be eligible for his military pension. It typically ends with the person’s death unless there was insurance or something in the divorce settlement. Did you talk about it in your divorce agreement?
That’s rough. If you were still married when he died, there’s a chance you could’ve received benefits related to Agent Orange, but since the marriage ended before, you can’t claim those. I’d recommend checking with a military lawyer if you want to be sure about anything though.
I’m really sorry, but it sounds like there’s no way to get the pension after death unless it was included in the divorce. You may want to reach out to a military lawyer for more clarity though.
If you were married for a long time while he was serving, that’s unfortunate. I think the key thing here is that you weren’t married at the time of his passing.
I feel for you. If you had been married at the time of his death, there might have been more options, but since you were divorced, that changes things. Hopefully, you can get some closure.
