Can I get Ohio to take control of my custody case... is that possible?

Hey everyone, I was given full physical and legal custody of my child, but it was originally issued in Hawaii. I’m living in Ohio now, and I was wondering if I could file to make Ohio take control of the case. Has anyone been through something similar or know if this is even likely to happen?

I think you can definitely file to get Ohio to take over, but it depends on a few things. If the dad is still in Hawaii, it might be tricky since they might not let go of the case easily.

Yeah, from what I know, if the other parent is still in the original state, they might not release jurisdiction. But Ohio could still enforce the Hawaii order for sure.

My friend had a similar situation. They got the new state to recognize the original order, but changes to it still had to go through the original state. Hope this helps!

Got it, thanks for sharing that! So Ohio can step in, but changes still need to go through Hawaii?

Just FYI, it’s harder to get a state to give up jurisdiction if one of the parents is still in the original state. But you can definitely try to work with Ohio on it.

Thanks for the heads up! Wasn’t sure how much the dad’s location would affect it.

If her therapist is recommending that she not fly or be unsupervised with her dad, that could play into your case. Might be worth discussing with a lawyer to see how it could impact the jurisdiction process.

I had a similar issue with custody across states. I had to prove no one was connected to the original state anymore. It’s a long process, but it’s possible!

Yeah, I’ve heard it’s a lot of paperwork and proving no connections. Definitely need to be patient with it.
