So, I’m dealing with a reserve officer issue and was wondering if I could reach out to someone for advice. I’m facing a complex situation involving military obligations and wondering if hiring legal help could actually make a difference here. Anyone have experience with this?
What’s the reserve officer issue about? Are you dealing with a contract problem or something like that?

Yeah, it’s kind of a mix. I took on TAR (Training and Administration of the Reserve) orders, which means I signed up for a 3-year commitment to August 2026. Now I want to leave early, but the Navy says I can’t because of those orders.

Wait, what’s TAR? Is that like regular active duty?

Close! TAR is active duty but specifically in the reserves. It’s more of a support role for reserve operations.
Did you decline continuation because you wanted to go back to a civilian job? Seems like they wouldn’t want to keep you if you have other plans.

Yep, I decided to decline continuation to go back to my civilian job. I already qualify for reserve retirement, so I thought it’d be an easy transition.
So what’s stopping you from just separating if you declined continuation?

That’s the catch! The Navy says my TAR contract holds, meaning I can’t separate until it’s done. But I was under the impression Title 10 would let me out since I declined continuation.

Title 10? Is that like a law about military obligations?

Exactly, Title 10 covers military rules for officer separation. Usually, if you decline continuation, you’re required to separate. But my TAR orders complicate things.
If you took TAR orders, wouldn’t that contract technically override Title 10?

That’s what the Navy is saying. They argue the contract takes priority, and I’d need a strong case to fight that in court.

Oof, sounds like they’re really sticking to that. Hiring a lawyer might be pricey with no guarantees.
@Ashton
Yeah, that’s my worry. Even if I hire someone to send a letter, the Navy likely won’t budge. Plus, a court fight would be crazy expensive.
Sounds like it’s all up to your command and their legal team… hoping they let you go if that’s what you want.

Exactly! It really depends on how the lawyers advise the command. Could go either way, so just trying to manage my expectations.
