Can my old boss hurt my chances with new employers?

I’m working at a new job now, and I listed my old job as a reference. I’m pretty sure my former boss might be giving me a bad reputation because we didn’t part on good terms. There’s this old company photo with me in it when I had a skin condition, and I worry he’s using that to make me look bad. Do I have any legal options here, or is there nothing I can really do about it?

If he’s actually spreading false info about you, it might count as defamation. You’d need some proof to make a case, though.

What counts as defamation exactly? I’m not too clear on it.

@AVERY
Defamation is when someone spreads lies about you that harm your rep, like false statements that mess with job chances.

Makes sense. My problem is I don’t really have solid proof. It’s just a strong feeling based on past experiences.

If he’s using true info, even if it doesn’t paint you in the best light, it’s usually not considered defamation. Only lies count.

True. Truth is a defense against defamation, so if he’s just saying things that happened, it’s tough to do anything.

Got it. I’m mostly worried he’s trying to make me look bad without any real reason.

If it’s affecting you and you don’t want to go to court, maybe try sending a cease and desist letter. Sometimes that stops them.

Good idea. I hadn’t thought about that option. Thanks for the tip!

Does defamation have a time limit for filing? I mean, if it’s been six months, is that still within the time to do something?

Usually, yeah. A lot of places have a two-year limit for defamation claims, but it depends on your state’s rules.

I’ll check the rules here. Thanks for bringing that up!

If your old coworkers won’t back you up, that’s tough. In small places, people are often loyal to the boss. Just document everything in case you need it.

Yeah, I think I’m on my own with this one… no one wants to step up.

Small town loyalty can be rough. Keep notes on anything that happens, just in case.
