Can schools be held accountable for this...?

I was running late to meet my son with special needs when his school bus dropped him off. There was an accident on the freeway, so I couldn’t get there in time. I tried calling the school, his teacher, and the transportation office, but no one answered. Later, my neighbor told me the bus driver handed him over to a stranger without confirming with us first. Thankfully, my son wasn’t harmed, but do I have a case for negligence? This feels so wrong.

That sounds super stressful. Did you file a complaint with the school yet?

Not yet, but I’m planning to. I just want to know if they can actually be held accountable.

Definitely report it. Even if no legal action, they should know this can’t happen again.

I think legally, they might not face much since your son wasn’t hurt. Did he seem upset by it?

No, he didn’t even realize anything was wrong, but that’s part of why I’m so upset.

I think they failed their duty though. IDK if laws in Michigan support that argument though.

Doesn’t the driver have a protocol to follow? They can’t just hand kids over to strangers, right?

That’s what I thought! There should be rules for this.

Yeah, they usually need parent confirmation. Sounds like they skipped it here. :person_facepalming:

This is wild. Even without injury, isn’t this emotional distress for you at least?

Exactly! I was panicking the whole time. IDK if that counts for anything legally though.

It might! Emotional distress claims can be tricky, but you could bring it up.
