So my son was searched at school and nothing was found. Then, the next day, they got an anonymous tip saying he had drugs. They searched his bag again, still nothing. When they asked to search his body, he refused, and now they’re saying they’re ‘assuming’ he has drugs and punishing him. But the school’s code of conduct doesn’t mention anything about punishing refusal for a search. Can they really do this??
That sounds messed up. If nothing was found, why would they assume he has drugs? I’d think it’s pretty unfair.

Exactly! It’s like they’re punishing him for exercising his rights. Honestly, it doesn’t seem legal at all.

I’d check the school policies again. Maybe there’s something hidden in the fine print that justifies it. Still seems shady tho…

I already checked, nothing about refusal. The only thing in the handbook is about refusing a urine test. Not really helping here.
I’m not a lawyer, but this seems like a huge overstep by the school. If he refused and nothing was found, how can they just assume he’s guilty?

Yeah, it’s kinda like they’re punishing him for something he didn’t even do. Legal advice sounds like a must here.

He felt it was unfair because they pulled him out of class two days in a row for a search. So he just said no this time.
You should totally contact a lawyer, especially with his 504 plan in mind. They’re probably not following it either.

Yeah, that’s what I’m thinking. His plan is supposed to help with situations like this, but they didn’t even offer a cool-down period.
