I was about to open the door of my car when a car driving by came fast and smashed my door as it was opening. I’ve got a video of the whole thing. Anyone know if I might be liable for this accident or is it the other driver’s fault?
Yikes, that sounds like a rough situation. From what I know, if the other car was speeding and you were just opening your door, it’s usually the other driver’s fault. But I’d definitely consult a lawyer to be sure.

Yeah, I agree with you. In most cases, the driver hitting the door would be at fault unless you were opening it into traffic or something. Did you get their info?

I didn’t get their info since it happened pretty quickly, but I’ve got the video of the whole thing so hopefully that’ll help.
Definitely the other driver’s fault unless there was something else going on. A video should be solid proof too.

Yeah, I’m hoping the video helps clear things up. Fingers crossed!
If the driver was speeding, that could make them more liable. Have you checked with your insurance yet?

Not yet! I was just trying to figure out if I’m in the clear first before contacting them.
It could also depend on local laws, but usually, if the door was opening and you weren’t blocking traffic, it’s not your fault. The video will probably be really helpful for proving your case.

Yeah, hoping the video makes it clearer. Thanks for the advice!
Oh man, that sounds stressful. It’s great you have a video, but I’d still suggest talking to a traffic lawyer. They can give you more specific advice based on your area.

I’m thinking of doing that. Just wanted to get an idea of what to expect first.
