Caught My Wife Cheating and Now Facing Custody Issues

You need evidence to support your claims. Without it, the court won’t care.

  1. Not an issue for custody
  2. Not relevant unless those people live with the child
  3. Did you report physical abuse?
  4. Not relevant; even sex workers can have custody.
  5. Are these issues from the past or present?
  6. You were also negligent for not getting the Social Security number.
  7. Request counseling for her.
  8. Her past actions as a minor don’t matter now.

@Eli
Agreed. Also, your approach sounds petty.

Has her time with him been supervised so far?

I guess? She’s with him in the morning before work and at night, but her mom is with him all day.

If visitation hasn’t been supervised, they may not see a reason to start now.

You need solid proof, and even then, I doubt you’ll get full custody or supervision. The judge may question why you waited to act if you were concerned about her care. I’m sorry you’re in this situation.

A judge will likely see through your attempts to punish her. You’ll probably get 50/50 custody.

thank you! just aiming for the best outcome.

You need a family law attorney. Good luck!

Talk to a family law attorney. The lifestyle issues you mentioned won’t be relevant unless they impact parenting.

You will likely go through mediation first. It’s important to focus on your child and document everything.

The only solid point you’ve made is about her negligence. The court generally wants to issue 50/50 custody unless there’s clear evidence of neglect or abuse.
