Hey, I’m going through a tough time right now. Got charged with battery on a cop and resisting arrest. It happened because I was manic (bipolar), and I didn’t even hit the officer, just pointed at him. They tased me, threw me down, and it was all pretty traumatic. Got burns and other injuries but didn’t see a doctor right away. I do have video evidence though. Anyone know what my defense options are for this?
Wow, that sounds intense. Have you thought about seeing a civil rights lawyer? They might take the case on contingency if they believe you’ve got a solid case.

I’ve thought about it… but money is kinda tight. Is contingency something they usually do?
@Rin
Yeah, for sure. Contingency means you don’t pay unless you win, but you’ll have to cover basic fees like filing.
@Rin
Right, and it also depends on how strong the case is. Video and doctor’s notes might really help here.
Did you ever get medical documentation for your injuries? Having that could be helpful if you’re going for a case against the police.

I took some photos but didn’t see a doctor right away. Just went later for anxiety and trauma. Is that enough?
@Rin
That’s something! Even if the injuries healed, records of trauma can still be evidence.
@Rin
Plus, a lawyer could probably use that for both your defense and any civil suit if you go that route.
What’s your defense in the criminal case? Does bipolar play into it?

Yeah, I was manic and don’t remember much. I read somewhere that could help my case since it affects intent.
@Rin
Totally. If you weren’t fully aware, your lawyer might argue you had no intent to resist.
@Rin
Definitely sounds like something a good criminal lawyer could work with.
Did you get a public defender or are you planning to hire your own lawyer?

I’m thinking about a public defender. Not sure if that’s enough though… any thoughts?

Depends on the defender. Some public defenders are awesome, but you might not get as much time with them as with a private lawyer.

Agreed. If funds are an issue, go with the public defender. Just make sure they’re fully briefed on the bipolar situation.
Honestly, sounds like you’ve been through a lot. Glad you got some help for the anxiety. Hope it gets better from here .

Thanks, appreciate that. Anxiety’s been rough, but getting through it. Just want this all resolved.
@Rin
One step at a time, hang in there. Legal stuff can be slow, but it sounds like you’re doing all you can.
