Child’s father wants to lower child support again... what should I do?

So, I share 50/50 custody with my child’s father, but I didn’t fully understand what that meant at the time. Now he’s filed a motion to lower child support again and wants more parenting time. He was originally ordered to pay $736, then we agreed on $300, and now he wants it down to $100-200 because he quit his job and is on unemployment. He also has a gun charge against him.

He owes $800 in child support and doesn’t even see our child, who is 6 years old, during his scheduled time. He’s verbally abusive, an alcoholic, and has threatened to harm my youngest child from my current relationship. My child has been living with me for 5 years, and I take care of everything like I have sole custody.

I really don’t want the child support to be lowered again. I think it’s best for my child to stay with me since he’s hardly around. Should I file a counter motion about his gun charge and all the other issues? Please help me. :sob:

It sounds like you’re doing everything right for your kid. Definitely consider filing a counter motion. Document everything!

You should definitely bring up his gun charge and any threats he’s made. That’s serious stuff!

Yes, I’m really worried about safety. I’ll make sure to include that.

Talk to your lawyer about showing that he’s not fulfilling his parenting time. That could help your case.

Make sure you have proof of everything, like the missed visits and the child support owed. That’ll help your argument.

It’s great that your child has been with you for so long. Courts often consider stability for the child.

I hope so! I just want what’s best for her.
