CMV: We should not charge people with resisting arrest if their arrest was unlawful

I am not talking about cases where someone is arrested and later found not guilty. I’m referring to situations where police misuse their power and arrest people on false charges, like arresting someone just for filming them.

I agree that if you’re being unlawfully arrested, complying can reduce the risk of harm. However, people understandably get angry and resist when they are arrested unjustly.

It’s troubling that someone can be charged with “resisting arrest” when they haven’t committed a crime that warrants arrest. Even if someone believes their arrest was unlawful, it seems wrong to penalize them for resisting an arrest that had no legal basis.

I’ve always found the idea of resisting arrest to be peculiar. Naturally, people will resist having their freedom taken away; it’s an instinctive human reaction. There’s no expectation that anyone should enjoy the experience.

In that case, I believe the charges would likely be dropped.
