I’m being denied continued service because of a QMP board after failing a UA. It’s my first time ever getting in trouble in my 11+ years of service. Is there any way I can get my Article 15 removed since the urinalysis wasn’t conducted properly? I feel like the chain of custody was broken. Any advice?

I didn’t. Honestly, I had no idea how to appeal. This is my first time dealing with anything like this.

The observer didn’t sign the observer briefing memo and ended up doing the test themselves. After I submitted my sample, another observer signed off without actually witnessing me give it.

Oh wow, that’s definitely a chain of custody issue. Did you bring this up to your chain of command?

I did, but they just shut it down. I even showed them AR 600-85 Appendix D Section 5, Paragraph V, which says this invalidates the chain of custody.
FYI, the Army Review Board Agency has a website where you can file an application to remove the Article 15. Might be worth a try.

They might, but just be aware that they usually assume the records are correct unless you have solid proof otherwise.

He’s legit. Keep trying to call or email. If you can’t get through, there are other good military lawyers out there too.
What does QMP mean? Sorry, I’m not familiar with all the acronyms.

It stands for Qualitative Management Program. Basically, they use it to separate soldiers for stuff like this.
