I’m a stripper in South Carolina, and when a customer pays with a credit card, we collect the cash at these times only. I also have a day job, and this setup seems illegal to me. Can anyone reference the legal code for this? TIA!
There isn’t a labor code specifically for 1099 employees. Since you’re contracted, the terms of your contract apply. But it sounds like you might be misclassified as a contractor.

Exactly, you should have a written contract. If you don’t, it’s tough to argue your case.

Right! Just make sure you know your rights as a self-employed individual, too.
If you’re self-employed, it’s legal, but if you’re told how and where to work, you might actually be an employee.

Yeah, your situation sounds tricky. If you’re self-employed, you can still take them to court for issues, but it won’t be under labor laws.
I’m curious, do they require you to pick up your pay physically at 1:45 AM? Seems odd if you can’t get paid electronically.

Yes, it’s only cash at that time. I have to wait until then to get paid.

That seems really inconvenient. You should look into how often you’re being paid, too.
A 1099 is not technically an employee status. If you’re self-employed and manage your own schedule, you’re in charge of how you get paid.

Yes, I get taxed at my day job, but not for the stripping. It’s confusing for sure.
