Is it okay to contact the lawyer’s assistant with new info about my case?

Hey, so I’m a Pro Se Litigant in a Federal lawsuit against a law firm for malpractice. I found some new info and I’m wondering if it’s okay to reach out to their attorneys directly to give them the update? Specifically, I found out they’ve placed an illegal claim lien on my deed, which is messing with my ability to sell my house and could push me into bankruptcy. What should I do?

That’s tough! I’m not a lawyer, but I’d suggest you send them a formal letter asking them to remove the lien. Let them know it’s causing you harm. If they ignore you, you might have to take it to court.

@CathyGenesis
Yeah, I agree. You could give them a deadline, like 30 days, to remove it. After that, file a motion with the court to get it taken off.

Got it! So, I should just go ahead and ask them to remove it, then take legal action if they don’t? Thanks for the advice!

I’m in a similar situation, and yeah, I’d recommend writing them a letter first. If that doesn’t work, then definitely go to court. You might be able to get damages too.

Thanks! Good to know I can ask for damages. That could help with the stress this is causing.

One thing I would clarify is what ‘baseless and illegal’ means legally for a lien. Are you sure they can’t prove it’s legit? Definitely get legal advice on that before jumping into court.

Yeah, the lien just showed up out of nowhere, and they didn’t follow the legal steps to put it on my deed. I’m pretty sure it’s not valid, but I’ll look into it more.

If it’s really hurting your ability to sell, definitely address it ASAP. Court action might take a while, but it’s worth fighting for your rights.

I agree! I can’t sell my house, and the stress is piling up. I’ll start with the letter and take it from there. Thanks for all the input!

Make sure you get everything in writing—proof that they ignored your requests could help if it goes to court. And maybe try to get a lawyer to look at the lien just to be sure.

I’m definitely keeping a paper trail. I’ll also check with a lawyer if I can afford it. Thanks for the reminder!
