Landlord charged me for not giving notice... what can I do?

I’m in a bit of a situation here. My landlord just charged me for 26 days of rent, claiming I didn’t provide the required move-out notice. But I have proof that I gave them over 30 days’ notice, and they even confirmed it. On 8/26, I filled out a notice to vacate on the resident portal, letting them know I would be moving out once the lease ended. The next day, on 8/27, my landlord contacted me to confirm that both my roommate and I would be moving out on 9/30, which is the end of the lease. Now, today, on 11/8, I got a letter saying they would be deducting $1,560 from my security deposit for what they say is “rent for 26 days (to complete the required 30-day notice).” I’ve reached out to them to figure out what’s going on or if this was a mistake, but I want to know what my options are if they come back and insist this is correct. I have a confirmation email from the resident portal regarding my move-out notice and text messages from the landlord confirming that they received my notice, both dated before the 30 days prior to the lease end date. Any advice would be appreciated.

That sounds really frustrating. I would definitely consult with an attorney to understand your rights in this situation. It seems like you have a strong case since you have all that proof. If they don’t pay you back, small claims court could be an option.

I had a similar problem with my landlord last year. It’s really important to keep records of everything. Don’t let them intimidate you. You have rights as a tenant, and they can’t just take your money without justification.

It sounds like you need to get some legal advice. If your landlord is acting in bad faith, you might be able to recover more than just the amount they owe you. Just make sure to act quickly because there are deadlines for these kinds of disputes.
