My daughter’s father was convicted for domestic battery against his pregnant girlfriend in Will County. He beat her up after their baby shower while drunk, and now he’s in jail until at least 12/5/24. I have court tomorrow for emergency custody in DuPage County, where our custody is set up. The clerk was able to serve him at his hearing today. Will he be in court tomorrow if it’s in a different county? How does this all work? I just want to make sure my daughter is safe with me and not with him. If he can beat up a pregnant woman, I’m terrified of what he might do with my daughter. Please help!
He has the right to be present, but depending on his situation, he might not make it. They often allow incarcerated people to appear remotely via video.
Yeah, in Illinois, the law generally assumes it’s not in the child’s best interest to be with an abusive parent. His conviction should work in your favor.
Make sure you have all your documentation ready. Any evidence of his abuse will help your case.
Definitely prepare to present why he shouldn’t have custody. Safety for your daughter is the priority.
Stay strong! You’re doing the right thing for your daughter. Just keep focused on her safety.
