Hey everyone… My partner got charged with a crime, but they’ve got serious mental health issues. I really want to get them transferred to mental health court instead of going through the regular system. Anyone know how to make that happen or have experience with it?
I’ve heard it’s possible if you can prove they have a diagnosed mental health condition. You might need to get a lawyer who specializes in that kind of stuff. Hope it works out!

Thanks! Do you know if public defenders can help with that or if we’d need to hire a private lawyer?
@Marlowe
Public defenders might be able to help, but it depends on their experience with mental health cases. A private lawyer could be more focused on your partner’s situation, though.
FYI, you might want to gather medical records and any past mental health treatment info. Courts usually need solid evidence to consider a transfer.

Good point. Also, sometimes the judge has to approve the transfer, so it helps if the lawyer can present a strong case.
What exactly is mental health court? Never heard of it before…

It’s a special court that handles cases involving people with mental health issues. Instead of punishment, they focus on treatment and support. It can be way more helpful for people who need care rather than jail time.

Oh, got it. That actually makes a lot of sense. Thanks for explaining!
If you can, reach out to a criminal lawyer who knows about mental health cases. They’d probably have better insight. I’d start with a consultation just to get some guidance.

Yeah, that makes sense. Do you know if consultations are usually free?
@Marlowe
Some are! It depends on the lawyer. Just call around and ask if they offer a free initial consultation.
Don’t stress too much—mental health court is designed to help people who need it. Just make sure your partner’s mental health records are up to date and talk to a lawyer who knows the system.

Totally agree. Courts usually appreciate it when you show you’re proactive about getting help.
