Not getting paid for mandatory work... what should I do?

I’ve been working for this company for about a year now, and they keep piling more work on me without any extra pay. I’m a facility level manager with area managers above me, and they’ve decided I can do their work too - all outside of my hourly work times. I have to start an hour before my shift and even work on my days off! They want me to do this every day, 7 days a week. I haven’t been paid for this work and want to challenge them, but I don’t know how to calculate what they owe me. Is there a minimum amount they should pay? Any regulations I should know about? I’m in Atlanta, GA, USA. Salary non-exempt hourly. Help!

All hours worked must be compensated. The law is clear on that. If you’re working on your days off, you need to clock in. It might be tricky because of overtime, but that’s on the employer, not you. They can write you up for working OT without approval, but they still have to pay you. You should also get back pay for the time already worked. If you don’t want to fight alone, file a complaint with your state or federal Dept of Labor. They can investigate, and it doesn’t cost you anything.

It’s understandable, but you have to document your hours. Your employer must pay for all hours worked, even if it wasn’t approved.

Nothing in the FLSA or Code of Federal Regulations says all work hours must be compensated. Some states do. If the uncompensated hours bring you over 40 hours, they must be paid. You are required to be compensated for all hours worked at least at minimum wage. Why haven’t you been clocking in?

Honestly, it’s the hassle of answering a million questions about ‘overtime.’ Maybe I should start clocking in instead of stressing about it.

Definitely. It’s your right to be paid for all the hours you work.

If you are salary, document all hours worked and ask for OT for any over 40 hours in a workweek.

It counts as hours worked. Whether it needs to be paid or not depends on the circumstances each week. Report your hours.
