I’m in a bit of a bind here. I missed my court date for a traffic violation, and now they’re revoking my license. Should I file for an appeal or ask for a reconsideration? I just don’t know what’s best. Anyone been through this before?
Yeah, I had a similar situation. The first step is requesting a hearing if you haven’t already. If that doesn’t work, then you can file an appeal. It all depends on how the hearing goes though.

Ahh got it, thanks for the tip! I just want to make sure I do this right. Any idea how long the process takes?

It can take a while depending on the court’s schedule, but I’d say at least a couple of weeks for a hearing. You should reach out to the court and check the status.
Sounds like you might need to file a motion to set aside the conviction. If they’re already looking to revoke your license, that could be your best bet to get another hearing.

I wasn’t sure about that, thanks! I guess I’ll need to ask about it at the courthouse. Do I need to explain the missed date?

Yeah, it’s helpful to explain why you missed it. You could also mention if there was any confusion about the date or anything else that led to you missing it. Might help your case!
Definitely file the motion to set aside the conviction. A judge might still be lenient since it’s pretty close to the date you missed. Don’t wait too long though!

Thanks for the advice, I’ll get on it. I’ve been stressing about this, lol. Hopefully, the judge will understand.
Did you get a notification about missing the date? I think they should send something out to remind you. I didn’t get anything for mine!

Nah, they didn’t send me anything. I only realized when I got the letter saying my license was getting revoked. Kind of a surprise, lol.

Yeah, that’s rough. They don’t always send reminders for missed dates, but a bench warrant usually comes if you miss a court date. Sounds like you might need to file the motion like others suggested.
So, you’re asking if you should file for an appeal or reconsideration, right? I think you should file the motion to set aside the conviction first. If that doesn’t work, then you can go for an appeal.

Yeah, that makes sense. Appreciate it. I’ll try the motion first and go from there.
