Truck hit my dog today and took off... am I liable for the truck damage?

A truck hit my dog today and killed him, then just took off from the scene. I’m in Ohio, and IDK if I’m liable for the damage to the truck. My dog, Ollie, broke his chain and I didn’t even know. The chain was still on him when it happened. Anyone know what I should do in this situation? :pensive:

I’m so sorry for your loss. That’s really tough. As for liability, you probably aren’t responsible for the truck damage since your dog wasn’t on a leash and the chain broke. The truck driver might be at fault for leaving the scene, though.

@Dallas
Thanks for your response. Yeah, the whole thing’s been overwhelming. So I’m not liable for the truck? That’s a relief to hear.

Sorry to hear about Ollie… If the driver didn’t stop, they might be liable for leaving the scene, especially in Ohio. But for the truck damage, you shouldn’t be responsible unless you were somehow involved.

@Noor
I didn’t think I’d be responsible, but hearing it from someone else makes me feel better. Thanks a lot!

I know it’s a tough situation. In Ohio, you’d typically be responsible if your dog was running loose, but the driver is at fault for hitting your dog and leaving the scene. You might want to file a police report.

@Kim
Good idea, I didn’t even think of filing a report. I’ll definitely do that, thanks!

I agree with what others have said. If the driver took off, they could be in more trouble than you. Make sure to contact a local attorney too, just to be sure about your situation.

I will, I think talking to an attorney might be a good next step. Thanks for the advice.

I’m so sorry about your dog. :cry: As for the liability, if your dog wasn’t under control, you could technically be held responsible for his actions, but in this case, it seems like the driver is more at fault for hitting your dog and leaving. Definitely get a police report if you can.

@Shay
Yeah, I’ll get on that. I guess it’s just been a lot to process. Thanks for your help!
