What can I do if medical insurance is suing me after my son's car accident... anyone been through this?

So my 19-year-old son got into a one-car accident while driving his granddad’s car. The granddad is my ex-wife’s dad. He took my son to the ER and called me, but when I arrived, the granddad left. My son and his granddad told the ER staff it was an accident but didn’t give any insurance info. I ended up providing my medical insurance and paid all the medical bills. Now my medical insurance is suing me! IDK what to do… any advice??

Oh man, that’s rough. Sounds like your medical insurance is going after you for reimbursement, right? That happened to a friend of mine. You might be able to get the auto insurance info from your ex-father-in-law somehow. Have you tried asking him again?

Yeah, same thing happened to me once. It’s called subrogation, where your health insurer goes after whoever caused the accident for the costs. You might need to reach out to the auto insurer if your ex’s dad won’t help.

No problem! It’s just when your health insurance pays for stuff, but then they try to get that money back from whoever’s responsible (like the car insurance). It’s a pretty standard thing.

You could also try asking for the accident report from the police. It might have the insurance details you need. Hope it works out for you!

You might want to talk to a lawyer about a subpoena if all else fails. They could help you get the insurance details from your ex’s dad or from the insurance company directly.

Yeah, I was thinking about that too. I just wasn’t sure how to go about it. I’ll look into getting a lawyer involved if needed.

Have you tried contacting your state’s insurance department? They might help you figure out how to get the info if you’re stuck. Especially if you’re facing a lawsuit now.

I haven’t yet, but I’ll give that a try. Thanks for the advice, I’m hoping they can help me out here!
