What happens if my roommates don't leave after the 30 days?

So I live with 3 roommates and we’re all on the lease. Thing is, 2 of them aren’t working and haven’t been paying their share of the rent. My fiancé and I gave them a 30-day notice in writing on Sept 5, asking them to leave by Oct 5. But like… what if they don’t leave? We already talked to the landlord, but they said they can’t do anything since we’re still paying our part. Kinda stuck and not sure what the next move is. Anyone dealt with this before?

Ugh that’s rough. If they’re on the lease, it’s tricky… you can’t just kick them out, even if they’re not paying.

Right? It’s so frustrating. I think you’d have to go through the courts and maybe file a writ or something like that?

@Keenan
Wait what’s a writ? Like a legal doc or something?

Yeah basically… it’s like starting a formal eviction process through court. You’d need to check with your local laws tho.

If they’re on the lease, the landlord prob won’t step in unless all of you get evicted. They told you that too right?

Yup exactly what they said. As long as we’re paying, they won’t act on it.

Sounds like you need to talk to a tenant lawyer tbh. They might help with how to file the right stuff in court.

Facts. I found legal aid super helpful when I had roommate drama like this.

You mentioned a consulate… do you mean like contacting them for legal help? Or were you thinking of something else?

Yeah I was confused on that too. I meant more like filing a complaint formally… not sure if consulate is the right word tho lol.

I think the next move is definitely legal action. If they’re still there after Oct 5, you can’t just throw them out… but a lawyer can help you start the right process.

True. And don’t forget to keep copies of that written notice you gave them. Might help later.

Good point. Dates matter too, so keep track of everything.
