What happens if you send ketamine through Uber and the driver gives it to the cops?

So, I sent 2 grams of ketamine by Uber and the driver ended up giving them to the police. I’m freaking out here. Do you guys think I’m in trouble? Is there any chance I can avoid charges or jail time?

Yikes, that sounds rough. If you’re in California, possession of ketamine is illegal without a prescription. It’s a misdemeanor for simple possession, but if it’s seen as possession for sale, it could get worse. You should talk to a lawyer asap .

@Merrick
Wait, what’s possession for sale? Does it make a big difference?

Yeah, it does. If they think you were going to sell it, it could be a felony. Basically, possession with intent to sell could mean up to three years in prison. But if it’s just for personal use, it’s usually a misdemeanor. Hope that clears it up .

IDK about all the legal stuff, but I’ve heard that California has diversion programs. If you’re eligible, you could avoid a criminal record by completing a drug treatment program. Might be worth asking your lawyer about.

@Huxley
Diversion programs sound like a good option. Do you know if it’s something you can request yourself?

Yeah, you can request it. It’s something that can be discussed in court, so definitely bring it up with your lawyer. They’ll be able to help you through that process.

I’m pretty sure you can be charged even if the ketamine wasn’t directly on you. If you gave it to the Uber driver, they’ll need to prove you possessed it, though. So it might come down to how they handle the situation.

@Remy
Hmm, interesting. So it doesn’t matter that it wasn’t in my pocket? It’s about if I gave it to them?

Exactly, it’s a fact issue. The cops would need to prove you had it and handed it over. That’s the key here.

If you’re guilty of possession, it sounds like your best bet is to ask for a lawyer and see if you qualify for diversion. That way, you can avoid serious consequences like jail time.

How would I know if I qualify for diversion? Is it automatic?

@Brady
No, it’s not automatic. You’d have to ask for it in court. Your lawyer will know the best way to go about it, though. I’d definitely recommend consulting one if you haven’t already.

Just wanted to add that if the police decide to prosecute, you could face a fine or even jail time, depending on how they charge you. It’s really important to have a lawyer guide you through this.

Wow, this is serious. I didn’t realise the penalties could be so harsh. Definitely gonna look into hiring a lawyer.
