It applies to leave as well; they’re not being fair to OP’s wife by filling her position while she is on leave. I believe there’s a case here.

Yes, but employers can’t force leave if reasonable accommodation is available for their conditions. Yet OP willingly took the leave, making it a different scenario. They didn’t obligate her to stay home, nor did they replace her as part of a reasonable accommodation. Therefore, OP’s request seems to fall outside the Act. Which part do you think applies to her situation?
