Would this be considered contempt of court?

My ex has denied all visitation for our son for a year, despite the court order. She’s made up excuses, and the court hasn’t done anything about it. After a recent hearing, they ordered therapy sessions for us to resolve his refusal for overnight visits. He didn’t show up for the first session, and I messaged her about it, but she hasn’t responded. I’m really frustrated because she asked for this therapy to avoid contempt but then doesn’t even follow through.

For context, she made false allegations against me just before our final orders hearing, which clearly was an attempt to gain sole custody. It’s been a mess, and my younger kids are affected too. I’m wondering what my options are since she’s violated the order she requested. Should I just wait for final orders in January, or is it worth filing for enforcement now?

It sounds like she’s definitely not following the court order. You might have grounds for contempt here. Talk to your lawyer!

You should document everything and consider filing for enforcement. It’s not okay for her to keep denying visitation.

I’d file for enforcement now. Courts generally don’t take kindly to repeated violations.

That’s what I’m thinking. Just worried about the timing with the final orders coming up.

Also, it’s important to keep records of all communications and missed appointments. It can help your case.

If she’s not complying with the court’s orders, you definitely have the right to pursue enforcement. Don’t let her get away with this!
