Anyone dealt with reckless driving charges in Oregon?

Hey all, I’m dealing with a reckless driving charge in Eugene, Oregon. I blew a 0.01 on the roadside breath test (barely anything!), but now they’re pushing for reckless driving. I’m also in a diversion program and thought that wouldn’t be held against me, but it seems like it is. Anyone have advice or been through something similar? What’s the best way to handle this?

Yeah, they said it’s about how I was driving, not the BAC. Something about ‘unsafe behavior.’ IDK what to do.

They can charge reckless driving even if alcohol isn’t involved. It’s more about how you were driving.

Did you talk to a lawyer? They might be able to challenge how the charge was filed.

Yeah, definitely. A local lawyer can tell if they messed up the evidence or the process.

What’s a diversion program? I don’t get how that fits in here.

It’s like a program to avoid a DUI conviction. You do classes, treatment, stuff like that. But I thought it wouldn’t affect other charges.

Ohh, I see. That sucks if it’s messing up your case now. Did they say if the new charge changes your program status?

What did the DMV say? If they don’t see reckless driving on your record yet, maybe there’s still time to fight it.

Yeah, they said it’s not on my record yet. I guess it only shows up after a court decision?

Exactly. It’s not final till the court resolves it. Maybe a lawyer can help reduce it to a lesser charge.

Reckless driving is a Class A misdemeanor, right? The penalties for that can be serious. Be careful.

Yeah, I read about fines, license suspension, and maybe jail. Kinda freaking out about it.

Don’t stress too much yet. A lawyer might be able to get it dropped or reduced if it’s your first offense.
