Anyone know about military insurance for an ex?

My divorce decree says I have to provide my ex-spouse with military health insurance. But if she doesn’t meet the requirements, am I on the hook to get her other insurance?

So, does she meet the 20/20/20 rule? I think that’s the main thing for keeping coverage after divorce.

No, we were married 17 years, so she doesn’t qualify under 20/20/20.

Got it. Then yeah, I don’t think TRICARE will keep covering her long-term. She might be eligible for one year, though.

That’s what I thought. Thanks!

If she doesn’t qualify for TRICARE, can the court really force you to pay for other insurance?

Seems like the court can’t make the military provide it, but they could order me to pay for other insurance if my decree says so.

Makes sense. So it just depends on what the decree actually says about coverage, then?

Yeah, exactly. It’s really about how specific the court order was.

I think she could still get TRICARE for one year, since your marriage was over 15 years even if it wasn’t 20. I’ve read that somewhere.

Yeah, that’s right. But she loses it after that year since we didn’t hit the 20-year mark.

Good to know! I didn’t realize there was a 15-year rule for temp coverage.

Wait, what’s this 20/20/20 rule everyone’s talking about?

It’s a rule where if you were married 20 years, the service member served 20 years, and there was 20 years of overlap, the ex-spouse keeps TRICARE for life.

Ahh, got it! Thanks for explaining. That makes sense now.

Honestly, sounds like you need a lawyer to go over the decree. Just to be sure about what you’re actually required to do here.

True, might be worth a consult just to double-check what I’m responsible for.

Good idea. Better safe than sorry when it comes to these things.
