Anyone know how to get my license back after a medical issue?

So, I had a pretty scary situation where I lost consciousness while driving and ended up off the road in a field. I have Congestive Heart Failure, and was on this heart med (Metoprolol) that caused some serious sleep issues and delirium. I tried telling my doctors, but no one took me seriously until it was too late. Anyway, after that night, I had to surrender my license, and now the DMV says I need a doctor to specifically address the LOC incident to get my license back. My doctors aren’t helping though… The one who prescribed the med won’t fill out the form, another one won’t comment on the incident, and my current doctor won’t say the med caused neurological problems. I’ve researched it and Metoprolol does cause these kinds of issues. I’m in Nevada, and I just need my license back so I can make it to all my doctor appointments. Anyone know the laws here about LOC incidents and getting your license reinstated?

Wow, that’s tough. Sounds like the DMV is being a pain. I don’t know much about Nevada’s laws, but I think they might require a letter saying you haven’t had another LOC in the last 3 months?

Yeah, I read about that too. They also said that if it was caused by meds, they’d want proof you’re not on them anymore. Not sure if that helps but it’s something.

Right, but they don’t want to accept the letter from the current doc. I guess they need it to specifically address that incident. So confusing.

Ugh, sounds like your docs aren’t being very helpful. Could you try getting a second opinion from a neurologist or something? Might help with the DMV forms.

I haven’t been required to see a neurologist, no. I don’t know if that would make a difference though. My current doc says I’m fine to drive.

That’s really frustrating. If they haven’t had any more issues in 3 months, I’m pretty sure you’re in the clear. But I’m not a lawyer. You might want to keep pushing them.

Yeah, I agree. If the law says 3 months without an issue, and your doc says you’re good to go, they shouldn’t be able to deny you.

I had a similar thing happen, and honestly, the DMV can be so stubborn. My suggestion is to make sure you get all the medical records you can and maybe even request a hearing to clarify things.

Thanks! I was thinking about requesting a hearing. If I point out what the law says, I’m hoping that’ll be enough.

I’ve been reading up on Nevada’s laws, and it sounds like if your doctor confirms you’ve been free from any LOC incidents for 3 months, that’s the key. The DMV seems to want the confirmation that it won’t happen again.

Exactly! That’s what the DMV says, but it’s so hard to get a doctor to just say that. They don’t want to be liable or something.
