CA - Terminating All Parental Rights

Long period of time My partner and I had a kid. We parted because he did not want to be a part of their lives. Not present at birth. We tried when he returned a year later, pleading to be a part of their lives. These days, he wants to leave. Is there anything legally he can do? Does this mean I have to go to court for him to give up my rights as a parent and student? He wants to go now, one more, and I truly want to make sure he does.

In California, if you don’t have a stepparent who can adopt the child, your best option is to draft a custody agreement that gives you, the petitioner, sole legal and physical custody of the child. Additionally, for β€œother” visitations as agreed upon by the petitioners. You will have to decide whether or not he sees the child when he eventually returns. He may attempt to alter the orders in the future, but it will be more difficult for him the longer these directives are in place. He can renounce his legal and physical rights, but he cannot renounce his need to pay child support, which is handled independently of custody and you are free to request it whenever you choose.
