Can I file for a parenting plan/joint custody while they still live with me?

I moved to North Washington with my ex and our newborn son earlier this year. Since then, our relationship has deteriorated, and I’m considering my options regarding custody. My ex is currently a stay-at-home mom, and while I work from home, she often takes our son out without telling me where they go. I want to know if I can file for a parenting plan or joint custody while she still lives with me, and if it’s feasible to do so. I’m also concerned about her mental health and drinking issues affecting our son’s wellbeing.

Have you discussed your concerns with her? It might be easier to work out a plan together before involving the courts.

You definitely need to establish a joint custody plan. Document everything, especially her drinking and temper issues, for the court.

Thanks for the advice! I’ll start documenting everything right away.

You can file for a parenting plan. Check Washingtonlawhelp.org for forms and instructions tailored to your county.

Yes, you can file. Talk to the court clerk for guidance on the process.

Propose a reasonable plan. If watching a one-year-old during work isn’t feasible, suggest an arrangement that maintains the current routine.
