I’m trying to figure out if I can file for divorce in the state where we got married, since I’m planning on moving back there soon. My spouse is getting new orders soon and we’re currently in Louisiana, but the divorce process here seems really long. Has anyone dealt with something similar? Can I file in the state I’m moving back to, or does it have to be where we’re living now? I’m so lost on the details of the process…
Hey, sorry you’re dealing with this… I think it depends on how long you’ve lived in the state you’re in now. Like, if you’ve been in Louisiana for more than 6 months, that’s probably where you’d need to file.
I was in a similar situation when I was stationed in a different state. You can move, but once you get to Texas and live there for a bit, you should be able to file. Also, about custody, I’d ask about temporary arrangements with a lawyer once you’re in Texas.
Just wanted to add, if you and your spouse end up in different states, once you have residency, either state can handle the divorce. But it’s good to know that Louisiana requires a year of separation before you can file there.
To add to the conversation, if you’re moving back to Texas, just make sure to meet the residency requirement. Usually, it’s 6 months, but check with a lawyer to be sure!
I know it’s tough, but it sounds like moving to Texas and filing after a few months could work out. If your spouse gets orders and moves too, that might make it easier, but check with someone who knows the specifics!
