Can I Get Custody of My Nephew?

Hello guys…I’m in need of some advice and guidance on a serious matter. My name is Paula Stevenson, and I’m looking to obtain custody of my 7-year-old nephew. The situation with his parents is complicated, and I’m worried about his well-being.

Unless they are shown to be unfit to be guardians, parents are the natural guardians and cannot have their guardianship taken away. A woman who cheats need not be unfit to be a guardian. Abuse, drug use, and criminal activity are examples of such things.

You have no legal rights over your nephew. Because only his mother or father, out of the two, may claim their son at the moment of divorce, and because you are not his exclusive natural guardian. However, you can adopt your brother’s child if you are childless and choose to pursue the adoption process.

If you feel like the child is in an unsafe environment, you can get custody but first contact child protective services or a local child welfare agency.

Yes one can get custody of his or her nephew if only the parents are unfit to take full care and responsibility of the child.
