Can I give short notice when resigning in Florida?

Hi all, I’m currently an exempt employee in Florida and my company requires a 30-day notice for resignations. However, there’s no penalty mentioned for giving shorter notice. Their PTO policy states that I’ll get paid for accrued PTO unless I’m terminated for misconduct, which isn’t the case for me. If I give less than 30 days’ notice, could this affect my PTO payout or lead to other issues? I know Florida is an at-will state, so I’m not sure how that factors in. Any thoughts?

In Florida, you really don’t have to give notice unless it’s in your contract. Their policy on PTO seems solid, so you should be fine there.

If they don’t pay out your PTO, you can file a wage claim with the federal DOL. Florida doesn’t have a state DOL for wage complaints.

Your company might not have a legal leg to stand on regarding the notice, but it’s always better to check your contract if you have one.
