Hi everyone! Quick question… I’m drafting a declaration for a custody hearing, and I was wondering if it’s okay to add exhibits or other attachments. Also, any tips on how to label them? Appreciate any advice!
Hey! Yeah, you can attach exhibits to your declaration. Just remember that they aren’t official evidence until they’re brought up in court and authenticated. You’d need someone who can vouch for them under oath.
@Finnley
Oh, got it! So they’re kind of just supportive for now, right? But I can mention I’ll bring them up in court?
@Finnley
Exactly, you can refer to them in your declaration but they only count once presented in the hearing. Helps to keep them organized too, like labeling them ‘Exhibit A’ and so on.
I’d say include a parenting plan as an attachment too if you’re wondering where to put it. Keeps it separate and easy to refer back to.

That’s a good idea, thanks! So labeling it as an attachment would work?

Yep, that works! Just call it ‘Attachment A’ or whatever fits. Keeps things neat and organized for the judge.
Just be careful with adding too many attachments. Judges prefer a clear declaration without tons of extras, unless they’re really important!

Good point! I’ll keep it to the most relevant ones then, so it doesn’t look cluttered.
If your lawyer hasn’t been communicating, maybe check in with them? It’s good to know their take on this too.

I have, but it’s been hard to get a response. Just hoping I’m doing this right until I hear back.

You’re on the right track! You’re doing great with getting organized, and hopefully, your lawyer will get back to you soon.
Random question, but is there a difference between ‘attachments’ and ‘exhibits’? I see both terms here, so just curious!

Good question! ‘Exhibits’ are usually specific evidence pieces, like photos or records, while ‘attachments’ can be extra documents you add for reference, like a parenting plan. Hope that helps!

Yeah, that clears it up! I think I’ll use ‘Exhibit’ for evidence-type stuff and ‘Attachment’ for the plan. Thanks!
