Can I Negotiate More Parenting Time by Adjusting Child Support Payments?

Hi guys…

I wanna reach out to my ex to discuss the possibility of increasing my parenting time with our child. My idea is to offer to forgo receiving child support payments or even to discuss a repayment plan if she agrees to grant me more time with our child.

Before I approach her, I want to make sure this is a reasonable and effective approach. Has anyone tried negotiating parenting time in exchange for adjustments to child support? How did you handle it, and were there any legal or practical considerations I should be aware of?

Hello Aggrey!
It’s great that you’re considering your child’s best interests.

Negotiating parenting time for adjustments in child support is possible, but it’s important to remember that child support and parenting time are separate issues in the eyes of the law.

Any changes should be done formally through a court or legal agreement to ensure they’re legally binding.

It’s also crucial to consider the potential impact on your child and your relationship with the other parent.

I would recommend consulting with a family law attorney to understand the legal implications better.

They can guide you on how to approach this conversation effectively.

Negotiating parenting time in exchange for adjustments to child support can be a reasonable approach, but there are several important considerations to keep in mind. Firstly, it’s crucial to ensure any agreement you make is formalized in writing and approved by the court to avoid potential disputes later. Verbal agreements may not hold up legally if there are disagreements in the future. Additionally, both parents must agree on the terms, and the court will need to approve any changes to the existing child support order. Be prepared for the possibility that your ex might not agree to the terms you propose, and consider consulting with a family law attorney to understand the legal implications and ensure that any changes are in the best interest of your child. An attorney can also help draft or review any agreements to ensure they are legally binding and enforceable.
