My partner went to the ER in Idaho back in July. She was diagnosed with costochondritis, but a different doctor later said it’s likely gallbladder issues. She’s in a lot of pain, can’t work, and the symptoms haven’t improved. We’re wondering if it’s possible to sue the ER doctor for a misdiagnosis… anyone familiar with situations like this?
Sorry to hear about that. Generally, to prove misdiagnosis, you’d need a medical opinion from another doctor saying the ER doc was negligent.

Makes sense. She does have another doctor now who confirmed it might be gallbladder-related. Would that be enough?
@Barrett
It’s a good start. If the new doctor can say the ER doc missed something obvious or did something against medical standards, you might have a case.
You might want to gather all her medical records and have them reviewed by another professional. They’d need to confirm if there was negligence involved.

Got it. We’re working on collecting the records now. Would that make it more likely for a lawyer to take this on?
@Barrett
Yeah, definitely. If the records show something was missed, a lawyer might see it as a stronger case.
Remember, proving causation can be tricky. Just because she had symptoms later doesn’t always mean the initial diagnosis was wrong. You’d need strong evidence.

True. We’re hoping the new doctor can confirm there’s a direct link. Fingers crossed it helps.
@Barrett
Best of luck. Hope it works out for you both.
I went through something similar. If the new doctor’s willing to back you up, it can really strengthen your case.

No worries. Just make sure everything’s well-documented and you should be good.
If you can, consult with a lawyer who specializes in medical malpractice. They’ll know exactly what’s needed to build a strong case.

Great tip. We’ll look into finding a specialist. Thanks for the advice.
@Barrett
Anytime. Good luck, hope it works out for you both.
