Can I tell the defendant's parent about the lawsuit before they've been served?

Hey all, I’ve filed a small claims case for breach of contract, but the defendant hasn’t been served yet. I’m wondering if it’s okay to let their parent know that they’re being sued, or is that a no-go since they haven’t officially been served yet? Anyone have any thoughts on this?

Hmm, I’d be careful with that. I’m not a lawyer, but I think you should wait until the defendant is served. Otherwise, it could cause issues with the case. Maybe someone with legal knowledge could confirm?

I think the lawyer’s advice would be key here. You might want to hold off on sharing anything with the defendant’s family until they’ve been served. There could be legal consequences otherwise.

As someone who’s gone through something similar, I’d say it’s best to let the lawyer handle the communication. I’d wait until the defendant is served to avoid any issues.

You can’t inform the parent yet, unfortunately. The defendant needs to be served first before any action like that can happen. Better to let the court process play out.

I’d suggest waiting on that. I know it feels like you want to give them a heads-up, but the rules are pretty strict about who can know about the lawsuit at what stage. Probably best to hold off.
