Can I withdraw my child from school after making an OCR complaint?

My child has special needs and has been bullied relentlessly for 6 years. I filed an OCR complaint, but it’s still pending. The school hasn’t done anything to address the bullying. Can I just withdraw my child from the school? I want to make sure I’m doing this the right way.

That sounds really tough. I think you can withdraw your child anytime, but you might want to check with the OCR to make sure it doesn’t affect your complaint.

Good point. I didn’t think about how it might affect the complaint. Thanks for the advice!

OCR complaints are about the school’s actions (or lack of them), so withdrawing shouldn’t impact it, but double-checking is smart.

Honestly, I’d withdraw them ASAP if it’s that bad. The bullying sounds unbearable.

Yeah, it’s been a nightmare. I just want to make sure I don’t mess up any legal stuff.

Makes sense. Maybe look into homeschooling or transferring to a private school? That could be safer for your kid.

Do you have a lawyer helping you? They could clarify how withdrawing might affect the complaint.

Not yet, but maybe I should get one. Thanks for the suggestion!

FYI, some lawyers offer free consultations, so it’s worth reaching out.

IDK much about OCR stuff, but as a parent, I’d prioritize my child’s safety over everything else.

Same here. I just hate that it’s come to this after so many years.

Totally get that. Do what’s best for your kid’s mental health, even if the school doesn’t get it.

Have you considered filing a separate complaint with the school board or escalating this to local media? Sometimes that gets faster results.

I haven’t, but I’m thinking about it. Maybe they’d actually do something if more people knew.

Media attention can definitely light a fire under them, but it’s a lot to deal with. Do what feels right.
