Hey, I’m in the middle of an eviction process and have a couple of questions. The tenants don’t have a lease and haven’t paid rent. Can we cut their internet during the eviction? Also, if they turned the AC very low while leaving the windows open and the AC isn’t working, do we need to fix it? And what if they complain that the AC isn’t cool enough or the fridge isn’t freezing properly, do we have to fix it during this period? Thanks for any advice!
That’s a tricky situation. Cutting the internet might be pushing it depending on where you are. I’d suggest checking local laws, but generally, utilities like internet could be seen as essential depending on the lease terms.
As for the AC, it depends on what your lease says about maintaining appliances. If they’re asking for repairs, you might need to fix it, but if it’s something they broke or messed with, that could be a different situation.
For the fridge and AC, it’s a grey area. If the appliances are still functioning and it’s not a safety issue, you might not need to fix them during the eviction. But if they complain and it’s something that’s covered by the lease, you could be required to fix it.
I’m in Florida too, and I know that tenant laws can be pretty strict here. You might want to make sure you’re following the formal eviction process before cutting anything off, even if it’s just internet. There could be penalties if you don’t go by the book.
I’ve been in a similar situation before. When it comes to repairs, it really depends on what’s broken and how long it’s been a problem. If it’s a minor issue, you may not have to fix it. But if it’s affecting the tenant’s living conditions, you might have to.
