Deadline tomorrow... should we act before court decision?

Hey everyone, we’re in the Texas Western District and dealing with a tight deadline tomorrow, the 18th. It’s for a student loan adversary proceeding, specifically the Pre-Trial Order and Proposed Findings of Fact and Conclusions of Law. We’re in the middle of settlement negotiations with Navient, which have been complicated and time-consuming. We filed an unopposed motion for a 30-day extension on the 13th, but the court hasn’t ruled on it yet. Navient already submitted their unilateral Pre-Trial Order and proposed findings. Since our motion is unopposed, do we wait for the court’s decision, or should we take some action before tomorrow to avoid any issues? Appreciate any insights!

If the motion is unopposed, the court will probably grant it, but I’d still check with the court clerk to be safe.

Good idea, thanks! I’ll reach out to the clerk tomorrow morning and see if they can give me an update.

Yeah, clerks can be super helpful in situations like this. Worth a call for sure.

If you’re not ready with your docs, you might want to prepare a basic version just in case the judge doesn’t approve the extension.

That’s a good point. Even a bare-bones version could show we’re making an effort if needed.

Exactly, better to have something ready than risk missing the deadline entirely.

Since the motion is unopposed, the judge will likely approve it, but sometimes they cut it close. Keep an eye on your email!

Yeah, I’m refreshing my email constantly at this point. Hoping for the best!

Lol, classic waiting game. At least it’s unopposed, so odds are in your favor.

What’s the worst-case scenario here if the judge doesn’t grant the extension by tomorrow?

Worst case, the court might view it as a missed deadline. Having at least a draft ready could help mitigate that.

Exactly why I’m leaning towards prepping something basic just in case. Thanks for pointing that out.

If the judge hasn’t ruled yet, maybe emphasize in your motion that Navient didn’t oppose it? That could help.

Good call, thanks! I’ll make sure we highlight that if we need to follow up.

Yeah, showing it’s unopposed makes it easier for the judge to grant it quickly.
