Did I break the law entering my tenant’s house late? Need advice!

So a tenant sued me for harassment and broke the lease. Their reasoning is that I entered their apartment multiple times between 8:30 pm and 10:00 pm without giving notice beforehand. I actually did give notice because I was there to repair a lock and record videos for other tenants. My question is, was the timing of my entry too late? Any insights on this? :pray:

Hmm, I don’t think entering between those hours is automatically illegal, but it could be considered late if you didn’t give enough notice. What state are you in? It might depend on local laws.

Yeah, some states require entry during normal business hours unless there’s an emergency. If you gave notice though, it might not be a big deal.

In my state, landlords are typically allowed to enter during normal business hours (like 9 am to 5 pm) unless there’s something urgent. If you were doing repairs, maybe it’s worth checking your lease terms to see if they specify anything about timing.

@Remi
Good point. The lease might have something about this. Might want to check with a lawyer just to be safe!

I’ve had similar issues with tenants not liking late visits. Even if you gave notice, they might still feel uncomfortable with the timing. I’d say the best move is to confirm with the lease rules and local laws. :thinking:

@Blaze
Yeah, I get that. Just making sure I didn’t do anything wrong legally. Thanks for the help!

Did you talk to the tenant before doing repairs? If you didn’t, they might have just felt like it was too late or unexpected. It’s always better to chat about timing before you go in.

I did give notice, but maybe I could’ve been more specific about the time. Thanks for the advice!

I’d definitely check with a local lawyer to make sure you’re covered, especially if the tenant is already upset. Better safe than sorry!
