So I’m dealing with an eviction, and I need to know if I have to be at the court clerk’s office in person to request a stay or file a motion to set aside. I’m thinking of doing it the day before the eviction date. Anyone have experience with this?

As long as you file as soon as possible, you should be good. The earlier, the better though.
I had to file something similar before. In-person is faster, especially if you’re cutting it close to the eviction date.

True. I’ve heard online can take too long for urgent stuff. Anyone know how early the court opens?

Usually around 8 or 8:30 AM. It’s best to double-check with your local court.
FYI, if the judge doesn’t rule on your motion within 24 hours, you might still have to leave but could move back if they eventually approve it.

Yeah, if your motion gets approved later, you’d have the right to return. Kinda a stressful situation, I know.

Yeah, mainly because it speeds things up. Less chance of delays.
