DUI Charge Despite 0.00 BAC and Negative Drug Test – Any Advice?

I’m an ER doctor who often works swing shifts, and I’m in a tough situation. On June 8th, I got pulled over for speeding (I was indeed speeding). Despite blowing 0.00 on the breathalyzer and testing negative for all drugs in a blood draw, I’m facing a DUI charge. They’re claiming I was likely under the influence of prescription medication that their routine tests don’t cover.

My lawyer has suggested pleading guilty, paying the fine, and going on probation, with the hope of getting it expunged in a year. He says it’s unlikely to win if we fight it, but I’m struggling with the idea of just pleading guilty.

How can they move forward with charges when I have clear evidence of not being under the influence? Is there any way to prove I wasn’t on any medication or fight this charge? I’m also worried about the potential impact on my job and future.

Sorry for the long post, but I’m really frustrated and concerned. Any advice would be greatly appreciated…Thanks

That sounds incredibly stressful, and I get why you’re frustrated. Here’s the thing: You’ve got solid evidence you weren’t under the influence, which is a big deal. It’s tough when routine tests don’t cover everything, but it doesn’t mean you’re out of options.

One approach could be to ask your lawyer about getting a more detailed analysis of your medical records or asking for expert testimony about the medications you take. Sometimes it’s worth digging deeper if there’s a chance to clear your name.

Remember, it’s okay to question your lawyer’s advice if you feel it’s not the right path. You might even want a second opinion to explore all possible defenses

Did you fail any tests to see if you were sober, like walking in a straight line?
